To obtain a UAE Corporate Tax Residency Certificate in 2026, a company must qualify as a UAE tax resident for the relevant period, meet the Federal Tax Authority (FTA) eligibility requirements, and submit an online application with the required supporting documents and fees. The official name is a Tax Residency Certificate (TRC). Businesses often use the phrase “Corporate Tax Residency Certificate” when applying for a company certificate.

What Is a UAE Corporate Tax Residency Certificate?
A UAE Tax Residency Certificate is an official certificate issued by the FTA confirming that the applicant is a UAE tax resident for a specified period. For companies, it may be used to evidence UAE tax residency to a foreign tax authority, bank, customer, group company or another party, depending on the purpose for which the certificate is requested.
Federal Decree-Law No. 28 of 2022 on Tax Procedures, as amended, provides that the FTA issues a Tax Residency Certificate to a Tax Resident in accordance with the applicable Cabinet decision (Article 53, Federal Decree-Law No. 28 of 2022 on Tax Procedures, as amended).
The certificate does not itself make a company tax resident. The company must first meet the relevant residency criteria. The TRC is evidence of the FTA’s conclusion for the period covered by the approved application.
Who Can Obtain a UAE Tax Residency Certificate?
A company can obtain a UAE Tax Residency Certificate where it meets the applicable UAE tax residency rules or the residency conditions in the relevant Double Taxation Agreement. The correct test depends on whether the application is for domestic purposes or to obtain treaty benefits in another jurisdiction.
UAE-Incorporated and Free Zone Companies
A juridical person incorporated, formed or recognised under UAE legislation is generally a UAE tax resident under the domestic tax residency rules. This includes companies incorporated in UAE Free Zones. A branch registered in the UAE by a foreign juridical person is excluded from this specific incorporation test (Article 3, Cabinet Decision No. 85 of 2022 on Determination of Tax Residency).
Being tax resident does not mean that every company has the same Corporate Tax treatment. Free Zone status, exemptions, tax grouping and other Corporate Tax rules may affect the company separately. Businesses can use Beaufort Associates’ Corporate Tax consultancy in the UAE where their residency position interacts with wider Corporate Tax requirements.
Foreign Companies and Foreign Branches
A foreign-incorporated company may still be treated as a UAE Resident Person for Corporate Tax if it is effectively managed and controlled in the UAE, subject to the Corporate Tax Law. Where a foreign entity seeks a TRC, the FTA may require evidence explaining why its effective management and control is in the UAE and supporting documents that demonstrate the actual decision-making position.
A UAE branch of a foreign legal person is not treated as a UAE tax resident merely because the branch is registered in the UAE under the domestic tax residency incorporation test. The status of the foreign legal person and the relevant treaty, where applicable, should therefore be considered before an application is submitted.
When Can a Company Apply for a Tax Residency Certificate?
A newly incorporated juridical person must generally have been established for at least 12 months before it is eligible to apply for a UAE Tax Residency Certificate. For an established juridical person applying for an ongoing 12-month period, the FTA 2026 Services Guide states that an application can be made after three months of that period have elapsed.
A certificate cannot be obtained for a future period that has not started, and it cannot cover more than 12 months. The requested period can generally be the company’s current or previous Tax Period, or another selected 12-month period, subject to the FTA requirements.
This timing should be checked early where a foreign tax authority or group company requires a TRC by a particular deadline. A newly established entity may not be able to obtain the certificate immediately after incorporation, even if it is already carrying on business in the UAE.
Which Type of Tax Residency Certificate Should a Company Request?
A company should select the TRC type based on why the certificate is needed. The FTA application distinguishes between a Tax Residency Certificate for Double Taxation Agreement purposes and a certificate for other purposes. Selecting the wrong category can lead to unnecessary questions or a certificate that does not meet the requesting party’s requirements.
Tax Residency Certificate for Double Taxation Agreement Purposes
A treaty-purpose TRC is used where a company seeks to establish UAE tax residency under a Double Taxation Agreement between the UAE and another jurisdiction. This may be relevant when claiming treaty benefits such as a reduced withholding tax rate or relief from double taxation, subject to the terms of the particular agreement.
For treaty applications, the FTA assesses whether the applicant meets the tax residency conditions in the relevant international agreement. If the FTA is satisfied, it may approve the application and issue a certificate identifying the applicable agreement (Article 2, Ministerial Decision No. 247 of 2023 on the Issuance of Tax Residency Certificate for the Purposes of International Agreements).
Each Double Taxation Agreement must be reviewed on its own terms. A UAE company should not assume that domestic UAE tax residency automatically guarantees entitlement to every treaty benefit.
Tax Residency Certificate for Other Purposes
A company can also request a TRC for purposes other than applying a Double Taxation Agreement. In that case, the juridical person must meet the UAE domestic tax residency criteria for the relevant 12-month period. The certificate may be requested by a bank, counterparty, regulator or another institution that requires evidence of UAE tax residency.
What Documents Are Required for a UAE Company?
A UAE company should prepare documents that establish its legal existence, business premises, authorised signatory and tax residency position. The FTA can request additional evidence where necessary, so the exact document set may vary according to the legal form, treaty, ownership and management circumstances of the applicant.
- Valid licence, such as the trade licence, and the relevant lease agreement.
- UAE Corporate Tax Registration Number (TRN), where applicable.
- Certificate of incorporation.
- Memorandum of Association; a certified copy is listed for Double Taxation Agreement applications.
- Authorised signatory details, including name, Emirates ID and passport.
- Evidence that the signatory is authorised to act, such as the establishment contract or a Power of Attorney.
- For a foreign entity relying on effective management and control in the UAE, a written explanation and supporting evidence showing how and where the entity is effectively managed and controlled.
For treaty applications, the FTA may also require information or evidence relevant to the particular Double Taxation Agreement. Companies should therefore review the treaty and the requesting jurisdiction’s requirements before filing.
How Do You Apply for a UAE Tax Residency Certificate in 2026?
A company applies electronically through the FTA’s Tax Residency Certificate service using its EmaraTax profile. The application requires the company to select the relevant TRN or indicate that it has no Corporate Tax TRN, choose the purpose of the certificate, complete the required information, upload documents and pay the applicable fees.
- Access the FTA EmaraTax portal and sign in to the relevant profile.
- Open “Other Services” and select “Tax Residency Certificate”.
- Select the applicant’s Corporate Tax TRN. If the applicant does not have one, select the “No TRN” option where applicable.
- Choose whether the certificate is required for a Double Taxation Agreement or for another purpose. For a treaty application, select the relevant country.
- Enter the required period and complete the remaining application details.
- Upload the supporting documentation relevant to the company and the purpose of the application.
- Request a printed certificate or international form stamping if needed.
- Pay the full application and review fee, then submit the application.
- Respond promptly if the FTA requests clarification or additional documents.
- After approval, download the digital certificate from the TRC service.
If the company still needs to complete its tax registration, Beaufort Associates’ Corporate Tax registration services can support the registration process separately from the TRC application.
How Much Does a UAE Tax Residency Certificate Cost in 2026?
The FTA currently lists a non-refundable AED 50 submission fee for a Tax Residency Certificate. The applicable review and issuance fee depends on whether the applicant is registered with the FTA for Corporate Tax. A printed hard copy is available for an additional fee. The FTA states that applicable service fees are non-refundable if the application is rejected.
- AED 50: non-refundable submission fee.
- AED 500: electronic TRC for an applicant registered with the FTA and holding a Corporate Tax TRN.
- AED 1,750: electronic TRC for a juridical person that does not have a Corporate Tax TRN.
- AED 250: additional fee for each requested hard-copy certificate.
The fees are government service fees and are separate from any professional fee charged for reviewing the residency position, preparing documents or managing the application.
How Long Does the FTA Take to Issue the Certificate?
The FTA’s Tax Residency Certificate service page, updated 11 August 2026, states that a completed Tax Residency Certificate application is generally processed within 10 business days. A request for a hard copy is listed at five business days from completion of the relevant fee payment. Additional time may be required where information is incomplete or the FTA requests further evidence.
Where a foreign jurisdiction requires its own international form to be stamped or attested, the company should allow additional time for completing, submitting and, where relevant, couriering the form. The period and country on the international form should match the related TRC application.
Is a Tax Residency Certificate the Same as Corporate Tax Registration?
No. Corporate Tax registration and a Tax Residency Certificate serve different purposes. Corporate Tax registration places a person on the FTA’s Corporate Tax register and provides a Corporate Tax TRN. A TRC is evidence that the FTA recognises the applicant as a UAE tax resident for the period and purpose stated on the certificate.
The TRC service allows an applicant to select “No TRN” in relevant cases, but providing a Corporate Tax TRN reduces the government processing fee and allows certain application information to be auto-filled. Separately, a company that is required to register for Corporate Tax must comply with its registration obligation and applicable deadline.
Companies should also keep their annual compliance up to date. Beaufort Associates provides Corporate Tax return filing services for businesses that require support with the return after registration.
What Common Mistakes Can Delay a Tax Residency Certificate?
TRC applications are more likely to be delayed when the requested period, purpose or supporting evidence does not match the company’s legal and tax position. Before filing, the company should confirm what the certificate will be used for and whether the requesting jurisdiction requires any additional treaty form or supporting document.
- Applying before a newly incorporated company has satisfied the 12-month establishment requirement.
- Selecting a domestic-purpose certificate when the document is required to claim a Double Taxation Agreement benefit.
- Selecting the wrong treaty country or certificate period.
- Submitting an expired trade licence, incomplete lease documentation or inconsistent company details.
- Providing authorised signatory information without sufficient evidence of authority.
- For foreign companies, failing to provide enough evidence of effective management and control in the UAE where that is relevant to the residency claim.
- Assuming a UAE Corporate Tax TRN automatically proves treaty residence without reviewing the relevant Double Taxation Agreement.
- Failing to pay the full application and review fee before submitting the application.

Часто задаваемые вопросы
What is the difference between a Tax Residency Certificate and a Corporate Tax Residency Certificate?
The official FTA term is Tax Residency Certificate. “Corporate Tax Residency Certificate” is commonly used by businesses when referring to a TRC for a company or other juridical person. The certificate evidences tax residency; it is not the same document as a Corporate Tax registration certificate.
Does a UAE company need to exist for 12 months before applying for a TRC?
Yes. Under the FTA 2026 Services Guide, a juridical person applying for a Tax Residency Certificate must generally have been incorporated or established for at least 12 months before it becomes eligible to apply.
Can a company apply for a Tax Residency Certificate for the current year?
Yes, subject to the eligibility rules. The FTA 2026 Services Guide states that an established juridical person can apply for an ongoing 12-month period after three months of that period have elapsed. A certificate cannot be requested for a future period that has not started.
Does a company need a Corporate Tax TRN to obtain a Tax Residency Certificate?
Not in every case. The FTA application process allows a “No TRN” option where applicable. However, a Corporate Tax TRN reduces the government processing fee, and the other contracting jurisdiction may require relevant tax registration information for a treaty-purpose application.
How much is a UAE Tax Residency Certificate for a company in 2026?
The FTA currently lists a AED 50 non-refundable submission fee. The electronic certificate fee is AED 500 for an applicant with a Corporate Tax TRN and AED 1,750 for a juridical person without a Corporate Tax TRN. A hard copy costs an additional AED 250 per certificate.
How long does the UAE Tax Residency Certificate process take?
The FTA’s Tax Residency Certificate service page, updated 11 August 2026, currently lists 10 business days from receipt of a completed TRC application. The timeline can be longer if the FTA requests additional information or if a separate international form or hard copy is required.
Can a Free Zone company obtain a UAE Tax Residency Certificate?
Yes, a Free Zone company can apply where it meets the applicable tax residency and FTA eligibility conditions. A juridical person established under UAE Free Zone legislation is generally treated as a UAE tax resident under the domestic residency rules.
Can a UAE branch of a foreign company obtain a Tax Residency Certificate?
A branch registered by a foreign juridical person is excluded from the UAE incorporation test for domestic tax residency. The residency of the foreign legal person, the Corporate Tax rules and any relevant Double Taxation Agreement should therefore be reviewed before concluding whether a TRC application is available.
Can the FTA stamp a foreign country’s tax residency form?
Yes. The FTA provides an international form stamping service where another jurisdiction requires its own form. The form should match the country and 12-month period in the related TRC application and must satisfy the FTA’s submission requirements.
